FYI - FBI Fingerprint Check and FOIA's

Hi Everyone,

I wanted to post some these links because I have answered this questions for a few people just in the last week through PM and regular threads. Hope this helps.

FBI Fingerprint checks -
Follow this link http://www.fbi.gov/hq/cjisd/fprequest.htm. There is detailed information on this webpage on how to fill out the forms and how to get the process done.

FOIA -
USCIS has their own form that you can print out and send in at http://www.uscis.gov/files/form/g-639.pdf. It has detailed instructions on how to get the process completed.

I should probably know this after being around for a while... but i don't.
What is the difference of the two??

FOIA is the Freedom of Information Act request where they search just by name and birthdate and any other infomation that you can provide. The FBI fingerprint check is done with name, birthdate and finger prints.

Dorothea - In essence - information is collected by two different agencies. FBI check would provide all records in regards to a person criminal history - Whereas the FOIA is more limited to ones immigration history/past.

The same information may or may not appear on both, however - personally, this is why I believe that most people who do one of the checks will often do both....

We did the entire process for the FBI check. It takes about 6-8 months for a response and the FOIA takes about a year. They have no quick way to get it faster. I also contacted them during the process. The told me at the FBI they never had our file. Then 2 months later the results showed up at our home. One suggestion if you are sending anything. Send it priority mail for a record that it was sent and recieved.

The FBI Check can be expedited if there is a good enough reason. I am not sure if Immigration process is one of them.

They are no longer expediting FBI checks. I got mine back last week after four months. I called to ask them the procedure to expedite and they stated they are so far behind that they are no longer doing it.
