    Affidavit of marriage by third party for I-130 filing

    I just went through the joint-account stage (co-mingling of financial resources requirement), thank you all for all the suggestions.

    Now, I am in a stage of preparing the affidavits (sworn to or affirmed by third parties) and come across this sample affidavit. Both mother in-law (wife’s mom) and brother in-law (wife’s brother) can attest to our marriage. My mother in-law is the witness to our marriage in San Francisco City Hall.

    Do affidavits have to be notarized? Is the personal statement is acceptable instead of affidavits? (I guess not )

    May I seek your inputs/suggestion/modification?

    [NAME] (person who makes statement) being duly sworn, deposes and says:

    I am making this affirmation in connection with bona fide marriage between [NAME] Applicant, and [NAME], Beneficiary
    The contents of the affirmation are based on my own knowledge and are true.
    2. I was born on [DATE] in [TOWN, COUNTY, COUNTRY].
    3. My address is [TOWN, COUNTY, COUNTRY].
    4. [NAME], the beneficiary, is my daughter.
    5. [WHEN THRID PARTY FIRST MET / BECAMAE AWARE OF RELATIONSHIP OF PETITIONER AND BENEFICARY]
    6. I was a witness at [NAMES] wedding on [DATE].
    7. I have personal knowledge of the bona fide of [NAMES] relationship. Their marriage is genuine.

    It would be a very good idea to get them notarized. With USCIS, you always want to go all out and give them the best you can come up with.

    Oh yeah. One other thing. I've read on VisaJourney that having witnesses simply say they attest to the bonafides of the marriage is NOT very useful to USCIS. The marriage certificate takes care of that. What they want in witness affidavits is more of a narrative, explaining details of what they've observed of the relationship. They want to know how the witnesses know the applicants, and what they've seen that would prove the relationship to be real.

    Again, I think in many cases these affidavits are just adding extra icing to the cake, but if you can, you might consider having them be more detailed than just attesting to the fact that the witness believes it's a bonafide marriage.

    Good point, Los G. Overstayed, what I did was have my aunt write a detailed letter explaining how she's pretty much a second mother to me, when she first met my husband (boyfriend at the time), her observations of us as a couple, when we first told her and her family about our marriage plans, how she's seen us grow as a couple and how we support each other, etc etc etc. Some of it was pretty cheesy, but when we had our I-130 interview (since I am in removal proceedings) our IO looked over the letter and said it was very well written. Oh and she got the letter notarized.
